Yup you have to send it back to Apple unfortunately. To do this, call the Apple troubleshooting phone line (# found on Apple website) and tell them your problem. If it can't be fixed, they'll mail you a box to put your iPod in (just the iPod or else they'll keep the other stuff you put in) and then Apple will fix it and send it back to you.
Take it to either Apple - I have heard that in some countries they will change the battery, in some they will recommend changing iPod. If you have problems there ask around, there are many shops that can do it.
